These Terms of Service (“Terms”) govern your use of the IntegralLift.com website and the services offered by Integral Lift (“we,” “us,” “our”), including forklift repair, sales, and rental services in Houston and Dallas, Texas. By accessing or using our website and by arranging for services through our company, you agree to these Terms. If you do not agree, please do not use our Site or services.
Services Description
Integral Lift provides forklift services in the United States only. We offer:
- Forklift Repair and Maintenance: We service, repair, and maintain forklifts at our Houston or Dallas locations.
- Used Forklift Sales: We sell used forklifts. All equipment is sold “as-is,” except for any express manufacturer warranty. You acknowledge that used equipment may have wear and tear.
- Forklift Rentals: We rent forklifts on terms agreed separately (normally by a written rental agreement or invoice). As the renter, you are responsible for proper use of the equipment.
We do not provide any services outside of the U.S. (No international sales or rentals). Any service requests from outside the U.S. will be declined.
Use of the Website
The IntegralLift.com website provides information about our services and allows you to contact us. You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site or any services to break any laws or regulations.
- Interfere with or impair the Site’s operation (e.g. hacking, viruses, overloading).
- Misrepresent yourself or provide false information.
All content on the Site, including text, images, logos, and data, is the property of Integral Lift and its licensors. You may download or print materials from the Site for your personal, non-commercial use only, provided you keep intact all copyright and trademark notices. No other use (including reproduction, distribution, or modification) is permitted without our prior written consent.
User Responsibilities
You are responsible for your own use of our services and equipment. Specifically:
- Accurate Information. You must provide accurate contact and billing information when requesting services.
- Compliance and Safety. If you rent or purchase forklift equipment, you must ensure it is operated and maintained safely and in compliance with all applicable OSHA and local safety regulations. You agree that forklift operation requires trained personnel; we disclaim any liability for accidents, injuries, or damages resulting from improper use of the equipment.
- Inspection. Upon delivery or pickup of any equipment, you should inspect it promptly. If there are defects or shortages, you must notify us within 10 days, or else the equipment will be deemed accepted.
- Legal Use. You will not use any services, including equipment, for illegal purposes or outside the scope of what is permitted by law.
You agree to indemnify and hold Integral Lift harmless from any claims, losses, or damages arising out of your violation of these Terms or your negligent or willful misuse of our equipment.
Orders and Payments
All service requests (repair, rental, or purchase) are subject to acceptance by Integral Lift. We may require a deposit for certain orders (e.g. special-order equipment or long-term rentals). Prices are based on current rates and do not include taxes, delivery, or fuel charges unless stated. Payment terms will be specified on invoices; in general, payment is due net within 10–30 days of invoice. Late payments may incur finance charges and/or repossession of equipment in accordance with Texas law. All sales of equipment are final; we do not refund or cancel contracts unless required by law.
Disclaimer of Warranties
Our website and services are provided “as is” without any warranties. Integral Lift and its affiliates make no representations or warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. The information on this Site is general guidance only; it should not be relied upon as the sole basis for any decision.
Limitation of Liability
To the extent permitted by law: Integral Lift shall not be liable for any damages arising from your use of the Site or services. This includes direct, indirect, incidental, special, consequential, or punitive damages (such as loss of profits, loss of data, or loss of use), even if we have been advised of the possibility of such damages. Your sole remedy for any dissatisfaction with services or products is to stop using them and seek any available statutory remedies.
Indemnification
You agree to defend, indemnify, and hold harmless Integral Lift (and our owners, employees, and agents) from any claims, damages, or expenses (including attorney’s fees) arising from: (a) your breach of these Terms; (b) your negligence or willful misconduct; or (c) your violation of any law or the rights of a third party. This obligation applies except to the extent that any claim is caused solely by our gross negligence or willful misconduct.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. By using our Site and services, you consent that any legal dispute will be resolved in the state or federal courts located in Texas (specifically Harris County for Houston or Dallas County, where applicable). We encourage both sides to resolve disputes informally, but if necessary, you agree that lawsuits or arbitration will be held in Texas under Texas law.
Changes to These Terms
We may revise these Terms from time to time. We will post the updated Terms on this page with a revised “Last Updated” date. You are responsible for reviewing these Terms periodically. Your continued use of the Site or services after changes are posted constitutes acceptance of those changes.
